These terms govern one Open Seat Day Pass. They are not a membership. A day pass gives you access to The Beach Off 111 for one day; it does not make you a Member, and the Membership Agreement does not apply to you.
1. What a day pass is
A day pass is access to the building for one calendar day, from 6:00 AM to 8:00 PM, on the date you choose when you buy it. The price is $39.00.
A day pass does not entitle you to any particular desk, seat, booth or room.
2. The date, and how far ahead
You choose your date when you buy. A pass may be bought for today or for any of the six days after it, and no further ahead than that.
3. Your door code
The Beach sends a door code to the email address you give, for the date on your pass. The code works from 6:00 AM to 8:00 PM on that date and stops working after it.
The Beach does not promise a time by which the code will arrive. Codes are sent by hand once The Beach sees your purchase, which may be after 6:00 AM on your day. A day's notice helps.
If your day has begun and no code has reached you, telephone (314) 249-8418 and The Beach will sort it out, including moving your pass to another day under Section 4 if the day cannot be saved.
4. If you cannot come
A day pass is not refundable in money.
If you cannot use the date you bought, tell The Beach before or after it and your pass will be moved once, to another date within seven days of the date you bought it for. Write to hello@beach111.com or telephone the number above.
5. What is not included
A day pass does not include printing, and it does not include the conference room.
The conference room may be booked by anyone, member or not, at the hourly rate published on the website. Ask for a time at beach111.com/room.
6. What is included
Wireless internet access, for which The Beach promises no particular speed and no uninterrupted availability; coffee, tea and hot chocolate; and the kitchenette, the lounge and the restroom.
7. How you are expected to behave
While you are in the building you shall: keep your voice down in shared work areas and use headphones for personal audio; take extended or hands-free calls outside the shared work areas; leave the space you used clean; respect other people's workspaces and property; and follow any reasonable direction from Management about noise, safety, security or conduct.
The Beach may end a day pass without refund, and require you to leave, for conduct that is disruptive, unsafe, dishonest or unlawful.
8. Your property, and your risk
You bring your property into the building at your own risk. The Beach is not a bailee of anything you bring and is not responsible for loss of or damage to it. Nothing may be left in the building overnight.
9. Your door code is yours
Your door code is personal to you. Do not give it to anyone else and do not let anyone in behind you. A code that is shared may be cancelled without refund.
10. Access is not guaranteed
The Beach may close the building, in whole or in part, for maintenance, for an emergency, or for any other reason. If The Beach closes on a day your pass is for, your pass will be moved to another date or refunded in full, at your election.
11. Limits
To the fullest extent the law allows, The Beach's total liability arising out of a day pass is limited to the amount you paid for it. The Beach is not liable for indirect, incidental or consequential loss, including lost business or lost data.
Nothing in these terms limits any liability that cannot lawfully be limited.
12. Changes
The Beach may change these terms. The version that governs your pass is the version published when you bought it, and the version you accepted is recorded with your purchase.
13. Law
Illinois law governs these terms.
